Welcome to www.creatingbetterdays.com (the “Site”), owned and operated by Nature’s Way Creating Better Days LLC (“Creating Better Days,” “we,” “us,” or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of the Site, your purchase of products, creation or use of an account, participation in subscriptions or messaging programs, and use of other services made available through the Site.

By accessing or using the Site, placing an order, creating an account, or otherwise using our services, you agree to be bound by these Terms and all policies incorporated into them by reference.

If you do not agree to these Terms, you should not access or use the Site.

Eligibility and Age Restriction, 21+

The Site and products offered by Creating Better Days are intended only for adults twenty-one (21) years of age or older.

By accessing the Site or purchasing a product, you represent and warrant that:

Creating Better Days does not knowingly sell or market age-restricted products to individuals under 21.

Creating Better Days manufactures, markets, distributes, and sells hemp-derived products intended for lawful adult use, including topical products, ingestible products, pet products, and other hemp-derived wellness products.

Product availability may vary by jurisdiction.

We make products available only where we reasonably believe their sale and shipment are permitted under applicable federal, state, and local requirements.

Nothing on the Site should be interpreted as a representation that every product offered by Creating Better Days is lawful for purchase, possession, use, or resale in every jurisdiction.

Compliance With Applicable Law

Creating Better Days also maintains its own shipping and product-availability restrictions and may decline to sell or ship a product when we believe the transaction may violate applicable law, carrier requirements, payment-processing requirements, company policy, or other regulatory restrictions.

We reserve the right to modify product availability and shipping restrictions without prior notice when laws or regulatory interpretations change.

Product packaging or labeling may also change before website photography or descriptions are updated.

If there is a material difference between information on the Site and legally required information appearing on the product's physical label, the physical product label should be reviewed before use.

Orders and Order Acceptance

Submitting an order does not guarantee that the order will be accepted or fulfilled.

Creating Better Days reserves the right to refuse, limit, hold, or cancel an order for legitimate business, regulatory, security, or operational reasons, including:

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

Shipping

All purchases are subject to our current Shipping Policy, which is incorporated into these Terms by reference.

Shipping availability, carriers, transit times, shipping charges, and restricted destinations may vary depending on the product and destination.

Delivery dates are estimates unless expressly guaranteed.

Creating Better Days is not responsible for delays caused by carriers, weather events, government actions, incorrect customer information, or circumstances outside our reasonable control.

Customers are responsible for providing an accurate and deliverable shipping address.

Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our current Return & Refund Policy, which is incorporated into these Terms by reference.

Certain products may be non-returnable due to health, safety, regulatory, promotional, or other restrictions.

Customers should review the Return & Refund Policy before returning any product.

Subscriptions and Recurring Purchases

Certain products may be available through recurring subscription programs.

When you enroll in a subscription, you authorize Creating Better Days and its payment-processing providers to charge the payment method associated with your subscription according to the frequency and terms selected during enrollment.

Subscription pricing, frequency, discounts, and availability may change in accordance with the terms presented at enrollment and applicable law.

You may manage eligible subscriptions through your customer account or subscription portal.

To avoid a scheduled recurring charge, subscription changes or cancellations should be submitted within the timeframe stated in our Subscription or Cancellation Policy.

Our current Subscription and Cancellation Policy is incorporated into these Terms by reference.

SMS and MMS Messaging Program

Customers who expressly opt in to Creating Better Days marketing text messages may receive recurring automated SMS or MMS communications.

Marketing messages may include:

  • New product announcements

  • Product availability updates

  • Company news

  • Cart or checkout reminders

  • Other marketing communications

By opting in:

  • You consent to receive recurring automated marketing messages at the telephone number you provide.

Wireless carriers are not responsible for delayed or undelivered messages.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site, Site content, and services are provided on an “as is” and “as available” basis.

Creating Better Days disclaims warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where such warranties cannot lawfully be excluded.

We do not warrant that:

  • The Site will always be uninterrupted or error-free.

  • All information will always be complete or current.

  • Every product will remain available.

  • Site functionality will be free from all security vulnerabilities or technical issues.

Nothing in these Terms excludes warranties or rights that cannot legally be waived.

Limitation of Liability

To the maximum extent permitted by applicable law, Creating Better Days and its owners, officers, employees, affiliates, representatives, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Site, products, services, or these Terms.

To the maximum extent permitted by applicable law, the aggregate liability of Creating Better Days for a claim arising from a specific order or product will not exceed the amount actually paid to Creating Better Days for the order or product giving rise to the claim.

For claims unrelated to a purchase, our aggregate liability will not exceed one hundred U.S. dollars ($100).

These limitations do not apply where liability cannot legally be limited or excluded.

Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of this section may not apply to you.

Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Creating Better Days and its affiliates, owners, officers, directors, employees, agents, contractors, and representatives from claims, liabilities, losses, damages, costs, or expenses arising out of:

  • Your unlawful or unauthorized use of the Site.

  • Your material violation of these Terms.

  • Your violation of applicable law.

  • Your infringement of another person's rights.

  • Fraudulent or intentionally wrongful conduct associated with your account.

This obligation does not apply to claims resulting from Creating Better Days' own unlawful conduct to the extent such limitation is prohibited by law.

Dispute Resolution, Arbitration, and Class Action Waiver

Informal Dispute Resolution

Before initiating arbitration, either party must provide the other with written notice describing the dispute and the requested resolution.

The parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days after receipt of the notice.

Notices to Creating Better Days may be sent to the contact information listed at the end of these Terms.

Binding Arbitration

If a dispute cannot be resolved informally, the dispute will be resolved through individual binding arbitration, except where applicable law permits the claim to be brought in small claims court.

Arbitration will be governed by the Federal Arbitration Act and administered by the American Arbitration Association (“AAA”) under the applicable AAA Consumer Arbitration Rules, unless the parties agree to another arbitration provider.

Arbitration may be conducted through written submissions, telephone, video conference, or in person as permitted by the applicable rules and agreed upon by the parties.

Nothing in this section prevents either party from seeking temporary or emergency injunctive relief where legally permitted.

Small Claims Court

Either party may bring an eligible individual claim in small claims court instead of arbitration, provided the claim remains within that court's jurisdiction and is pursued only on an individual basis.

Class Action Waiver

To the fullest extent permitted by law, disputes must be brought on an individual basis.

Neither you nor Creating Better Days may participate in a class action, collective action, consolidated action, private attorney general action, or representative proceeding against the other party regarding a dispute covered by this section.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual's claim.

Arbitration Opt-Out

You may opt out of the arbitration and class-action provisions by providing written notice to Creating Better Days within thirty (30) days after first becoming subject to these Terms.

Your notice must include your name, contact information, and a clear statement that you wish to opt out of the arbitration agreement.

Opting out of arbitration does not affect any other provision of these Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent federal law or the laws of another jurisdiction are required to apply.

Nothing in this provision is intended to deprive a consumer of mandatory protections available under the laws of their jurisdiction.

Termination

We may suspend, restrict, or terminate access to the Site or services when reasonably necessary due to:

  • Violation of these Terms.

  • Fraud or suspected fraud.

  • Unlawful activity.

  • Security concerns.

  • Abuse of our services.

  • Regulatory requirements.

  • Conduct that creates material risk to Creating Better Days or other users.

Termination does not affect rights or obligations that arose before termination.

Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and other provisions that by their nature should survive termination will remain effective after termination.

Force Majeure

Creating Better Days will not be liable for delays or failures caused by circumstances outside our reasonable control, including natural disasters, severe weather, carrier disruptions, supply shortages, labor disputes, telecommunications failures, cyber incidents, government actions, regulatory changes, public emergencies, or similar events.

This provision does not limit rights that cannot legally be waived.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

Waiver

A failure by Creating Better Days to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Creating Better Days may assign these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or other lawful business transaction.

Entire Agreement

These Terms, together with the policies and agreements incorporated into them by reference, constitute the agreement between you and Creating Better Days regarding your use of the Site and related services, except where a separate written agreement expressly applies.

If a specific policy governs a particular subject, such as shipping, returns, subscriptions, or privacy, that specific policy will control for that subject in the event of an inconsistency.

Section headings are provided for convenience and do not affect the interpretation of these Terms.

Changes to These Terms

We may revise these Terms periodically to reflect changes in our business, Site functionality, products, legal obligations, or regulatory requirements.

When changes are made, we will update the “Last Updated” date at the top of these Terms.

Where required by applicable law, we may provide additional notice or request additional consent before material changes become effective.

Your continued use of the Site after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
